SELLBY TERMS OF SERVICE
These Terms govern your access to and use of the SellBy application and related services (the “Service”). By using the Service, you agree to these Terms.
1. The Service
SellBy is an AI-powered software tool that assists users in generating listing drafts, pricing insights, and marketplace recommendations.
SellBy is not a marketplace and does not process transactions between buyers and third-party platforms.
2. AI & Marketplace Disclaimer
SellBy provides AI-generated insights, including pricing estimates and marketplace recommendations. These outputs are probabilistic in nature and may be inaccurate or incomplete.
AI outputs do not constitute financial, legal, or professional advice. You are solely responsible for verifying all information before publishing listings.
SellBy is an independent software tool and is not affiliated with, endorsed by, or officially connected with eBay, Vinted, Amazon, Meta (Facebook), StockX, or other marketplaces.
3. User Responsibilities
- You are responsible for the accuracy and legality of all content you create.
- You must comply with marketplace rules and policies.
- You must review AI-generated outputs before use.
4. Marketplace Integrations
If you connect a third-party marketplace account, you authorize SellBy to store and use OAuth tokens to access marketplace APIs on your behalf.
SellBy is not responsible for marketplace enforcement actions or restrictions.
5. Payments, Subscriptions, and Credits
Digital purchases and subscriptions for iOS are processed via Apple In-App Purchases. Subscriptions automatically renew unless canceled at least 24 hours before the end of the billing period.
Credits have no cash value and are non-transferable.
6. Service Availability
The Service is provided on an “as available” basis and may be modified or discontinued at any time.
7. Disclaimer of Warranties
To the maximum extent permitted by law, the Service is provided “AS IS” without warranties of any kind.
8. Limitation of Liability
SellBy shall not be liable for indirect or consequential damages. Where liability cannot be excluded, it is limited to the amount paid by you to SellBy during the preceding three (3) months.
9. Governing Law
These Terms are governed by the laws of Lithuania. Mandatory consumer protection rights remain unaffected.
